The decision was adopted by six votes to three and represents a judicial setback for the Republican administration. The conflict originated on October 4, when Trump ordered the activation of 300 members of the Illinois National Guard for federal active duty, primarily in the city of Chicago and its metropolitan area. The next day, members of the Texas National Guard were also federalized and sent to the same destination. In response to that decision, on October 9, the U.S. District Court for the Northern District of Illinois issued a temporary restraining order prohibiting the federalization and deployment of the National Guard in the state. This measure was ratified on October 16 by the Seventh Circuit Court of Appeals, which, while enabling federalization, prevented the effective deployment of the troops. Faced with that scenario, the Trump administration turned to the Supreme Court, which has now confirmed the block and left in place the impossibility of using the Illinois National Guard for internal security tasks under these conditions. 'At this preliminary stage, the Government has not been able to identify a source of authority that would allow the armed forces to enforce the laws in Illinois,' the court stated in an order issued through its official website.
